Terms & Conditions

The rules that govern your use of ListZar, South Africa's marketplace for products, services, property and business profiles.

Effective date: 4 October 2026Last updated: 4 October 2026

This document is provided to explain how ListZar operates and handles information. It should not be treated as legal advice.

1.Introduction

ListZar is an online marketplace that lets users publish listings for goods, services, property and business profiles, and lets other users discover and contact those publishers. ListZar provides the technology platform only. It is not a seller of the goods or services listed, and it is not a party to agreements reached between users.

ListZar is a trading name of M and M Tembe Holdings (registration number 2012/014334/07), a company registered in South Africa. In these Terms, “ListZar” refers to M and M Tembe Holdings, trading as ListZar, the operator of the platform.

These Terms & Conditions, together with the Privacy Policy and the Safety Centre, set out the rules for using ListZar (together, the “Terms”).

2.Acceptance of Terms

By creating an account, browsing listings, publishing a listing, sending a message, leaving a review, or otherwise using ListZar, you agree to these Terms. If you do not agree, you should not use ListZar.

If you are accepting these Terms on behalf of a business, you confirm that you are authorised to do so.

3.Eligibility and Accounts

  • You must be at least 18 years old and legally able to enter contracts in South Africa.
  • You must provide accurate, complete information when registering and keep it up to date.
  • You are responsible for keeping your password and account secure, and for all activity under your account.
  • You may not transfer your account to another person without ListZar's agreement.
  • One person may maintain only one account for personal use. Business profiles are managed separately.

4.User Responsibilities

You agree to use ListZar lawfully and honestly. In particular, you will:

  • Comply with all applicable South African laws, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, where they apply to your activity.
  • Provide accurate information and not mislead other users.
  • Respect the rights and safety of other users.
  • Not attempt to disrupt, overload, or gain unauthorised access to ListZar or its data.

5.Listings and Seller Responsibilities

If you publish a listing, you are the seller of the item or provider of the service and you are responsible for it. You confirm that:

  • The listing is accurate and the photos are genuine and current, not stock or misleading images.
  • You have the right to sell or offer what you list, and it is lawful to do so.
  • The price and description are correct, and the currency shown is South African Rand (ZAR) unless stated otherwise.
  • You will respond to genuine enquiries in good faith.
  • You will remove or update a listing once the item is no longer available.

ListZar does not verify ownership, condition, authenticity, availability, safety, or price of any listing. Listings may expire after a period set by the platform (currently 30 days) and can be renewed by the seller.

6.Buyer Responsibilities

If you contact a seller, you are responsible for evaluating the listing and the seller yourself. ListZar does not guarantee any listing or transaction. You should:

  • Inspect goods in person wherever practical before paying.
  • Confirm the item matches the listing before agreeing.
  • Conduct your own due diligence on the seller and the item.
  • Follow the practical guidance in the Safety Centre.

7.Business Profiles

Users may create business profiles to represent a sole proprietor, partnership, company or other organisation. The user who creates a business profile is responsible for the accuracy of the information shown and for their authority to represent that business.

A verification badge or status, where shown, indicates only that ListZar has taken certain steps to confirm a detail. It is not a guarantee of a business's legitimacy, financial standing, or the quality of its goods or services.

8.Prohibited Content and Activities

You must not publish or attempt to do any of the following on ListZar:

  • Illegal, stolen, counterfeit, or prohibited goods or services.
  • Fraudulent content, fake proof of payment, or requests for OTPs, PINs, passwords, or banking credentials.
  • Financial scams, pyramid schemes, or offers of guaranteed returns.
  • Misleading or false information, including false advertising.
  • Content that infringes another person's intellectual property or other rights.
  • Another person's personal information published without a lawful basis.
  • Hateful, abusive, or harassing content aimed at other users.
  • Malware or content designed to harm devices or deceive users.
  • Any attempt to bypass ListZar's safety, reporting, or moderation mechanisms.

This list is not exhaustive. ListZar may treat other conduct that harms the marketplace or its users as a breach of these Terms.

9.Pricing and Transactions

Listings show prices in South African Rand (ZAR) by default. Any agreement to buy, sell, or pay is made directly between the users involved. ListZar:

  • Does not process payments between buyers and sellers.
  • Does not hold deposits, provide escrow, or guarantee refunds.
  • Is not a seller of listed goods or services and does not become one merely because a listing is published.
  • Does not guarantee that any transaction will be completed.

Nothing in these Terms excludes any mandatory consumer rights you may have under South African law, including rights that cannot be excluded under the Consumer Protection Act where it applies to your transaction.

10.Messaging and Communications

Messaging helps buyers and sellers communicate about listings. You agree to use messages honestly and not to harass, threaten, or defraud anyone. ListZar does not routinely read your private conversations. Messages may be processed to operate the service and, where required by law or to investigate serious breaches of these Terms, may be reviewed by authorised personnel.

11.Reviews and Reputation

Reviews let users share their experiences. You agree to:

  • Write honest reviews based on genuine experience.
  • Not post fake, paid, or retaliatory reviews.
  • Not use reviews to abuse, threaten, or extort anyone.

A reputation score or review count is a summary of other users' reviews. It is not proof that a person is trustworthy or that a transaction is safe.

12.Intellectual Property

ListZar, the ListZar name and logo, and the platform's design and software are owned by ListZar or its licensors and are protected by South African intellectual property law. You may not copy, redistribute, or misuse them.

13.Content Submitted by Users

You remain responsible for content you submit, including listings, photos, descriptions, business profile details, reviews, and messages. By submitting content to ListZar, you grant ListZar a non-exclusive, royalty-free licence to host, display, reproduce, and process that content solely to operate and improve the marketplace. You confirm that you have the rights needed to grant that licence.

14.Platform Availability

ListZar aims to keep the platform available but does not guarantee uninterrupted or error-free access. Maintenance, updates, and events outside ListZar's control may cause interruptions. Listings may also be unavailable if expired, removed, or hidden under these Terms.

15.Third-Party Services and Links

Listings, business profiles, and messages may contain links to third-party websites or services. ListZar does not control or endorse those third parties and is not responsible for their content, products, or conduct. You use third-party services at your own risk.

16.AI-Assisted Features

ListZar offers optional AI-assisted features, including listing suggestions, search interpretation, seller and marketing suggestions, SEO suggestions, safety suggestions, business marketing suggestions, customer support guidance, and orchestration between specialist assistants.

AI output is generated support, not guaranteed fact. It must not be treated as:

  • Legal, financial, or professional advice.
  • Proof that a person is a scammer or that a listing is legitimate.
  • Proof of product authenticity or safety.
  • A substitute for your own judgement.

Actions suggested by AI that change your listings, business profile, or account require your human approval before they are applied. AI does not perform autonomous moderation, suspension, or removal of users or content.

17.Safety and Fraud Prevention

ListZar provides safety guidance, reporting tools, and moderation to help reduce risk. These are precautions, not guarantees. ListZar does not guarantee that any user, listing, or transaction is safe, and cannot prevent all fraud. You remain responsible for your own safety, as set out in the Safety Centre.

18.Reporting and Moderation

You can report a listing from its detail page, a review from the review itself, and other concerns through the reporting tools provided. When you report something, choose a reason and add a short description.

Reports may be reviewed and appropriate action may be taken in line with ListZar's rules and applicable law. ListZar does not promise that every report will result in removal, nor that action will be visible to the person who reported it.

19.Suspension and Termination

ListZar may suspend, hide, or remove content, or suspend or close an account, where it considers that these Terms have been breached or to protect the marketplace or its users. You may close your account at any time. Listing and review data may be retained as set out in the Privacy Policy.

20.Limitation of Liability

To the extent permitted by South African law, ListZar's liability for any claim arising out of your use of the platform is limited to the extent permitted by law and excludes liability for indirect or consequential losses. This does not affect any non-excludable rights you may have under the Consumer Protection Act or other applicable law, nor does it exclude liability for ListZar's own gross negligence or wilful misconduct where the law does not allow such exclusion.

21.Indemnity

To the extent legally permitted, you agree to indemnify ListZar against claims, losses, or damages arising from your breach of these Terms, your content, or your dealings with other users, except where South African law does not allow such indemnity.

22.Privacy and Personal Information

ListZar handles personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). Full details are in the Privacy Policy.

23.Changes to These Terms

ListZar may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were last revised. Continuing to use ListZar after a change means you accept the updated Terms.

24.Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally will be dealt with in the South African courts with jurisdiction, subject to any mandatory consumer dispute rights you may have.
